A New Model for International Criminal Justice?

Guatemala, May 10, 2010. A new Human Rights First report published in the Journal of International Criminal Justice analyses the groundbreaking but little understood International Commission against Impunity in Guatemala (CICIG) to develop an improved rule of law model for the UN in reforming weak legal systems. It engages in an in-depth study of CICIG’s activities and a comparative analysis of CICIG against similar international criminal justice mechanisms. Human Rights First argues that CICIG’s level of integration into the local judicial system and its dual focus on powers to promote prosecutions and institutional reform tools make it a unique model worth replicating. This report also makes recommendations to further improve CICIG’s model for future application to new contexts and countries.

This is good news because the rule of law prevails. I understand that many Guatemalans feel pain, they even feel shame to see a former president who has represented them all subject to criminal prosecution, but it was he who decided to launder money in the United States, and that cannot be blamed on anyone else.

Court of Conscience On Sexual Violence Against Women

Guatemala, 5 March 2010. During the 36 years of internal armed conflict that took place in Guatemala, rape was widespread, massively and systematically committed by government agents as part of the counterinsurgency policy. It was used as an instrument of war and a tool to generate terror, violating human rights and international humanitarian law. It was widespread during the massacres and in most cases the precursor of death.

  Inside CICIG
Mandate
 The United Nations and the Government of Guatemala signed the Agreement Relative to the Establishment of an International Commission Against Impunity in Guatemala (CICIG) on 12 December 2006.
Commissioner
 CICIG is headed by Dr. Carlos Castresana Fernandez, who was appointed Commissioner and Assistant Secretary General by the Secretary General of the United Nations on 14 September 2007.
Cases
 Under Article 3(b) of the 12 December 2006 UN-Guatemala Agreement for the creation of CICIG, the Commission has the power to join a criminal proceeding as a complementary prosecutor with respect to all cases within its mandate.
